Saffie’s Spirit Competition: Terms & Conditions

  • The Promotion is only open to residents of the United Kingdom only. The following
    individuals are not eligible to enter the Promotion:
    a) employees and agents of the Promoter, News Corp UK & Ireland Limited or other
    group companies;
    b) employees and agents of any organisation directly connected with the operation or
    fulfilment of the Promotion (including third party promotional partners) and their
    respective associated, affiliated or subsidiary companies;
    c) the immediate families and household members of all such employees and agents
    referred to in (a) and (b); and
    d) individuals under 18 years of age.
  • The Promotion starts at 00.01 AM (UK time) on 6 July 2024 and closes at 23.59PM (UK
    time) on 29 July 2024 (the Promotion Period). Any entries received outside the
    Promotion Period will be void.
  • Participants may make a maximum of one entry per person during the Promotion
    Period. Participants may only win one prize per person, irrespective of the number of
    entries submitted. Bulk, automatically generated or third party entries are void. At the
    end of the Promotion, participants' entries will not be returned to them.
  • To enter you must complete form at www.thesun.co.uk during the Promotion Period
    only. You must tell us about a young person (16 or under) who has gone above and
    beyond for others, their community/family school and deserve to win a Saffie’s Smiles
    Award. Perhaps they have shown incredibly bravery, courage in the face of adversity
    or have worked incredibly hard to support others.
  • Entries to the Promotion must be the original work of the participant and not
    previously published. Entries which are or in the Promoter's reasonable opinion
    appear to be plagiarised will be disqualified. Participants acknowledge and agree that:
    (a) they have obtained all rights, licences, and permissions necessary, in writing,
    from any person who may have helped create and/or be featured in their entry;
    and
    (b) their entry to the Promotion (including any text and photographs):
    (i) does not contain or feature any personal information about any person
    (including their name, contact details, a photograph of them and/or any
    other identifying information) without that person's consent (proof of which
    must be provided to the Promoter upon request);
    (ii) does not contain any content that is defamatory, libellous, racist,
    homophobic, derogatory, pornographic, obscene, sexist, illegal, and/or
    otherwise inappropriate;
    (iii) does not include trade marks, logos, or copyright protected material which
    belongs to third parties without permission (including company names,
    music, photographs, motion picture or television programme clips or audio
    tracks, works of art, or images published on or in websites, television,
    movies, or other media);
    (iv) is not subject to any third party agreements and the Promoter will not be
    required to pay any sums to any third party as a result of the Promoter's use
    (as set out in these Terms and Conditions) or the exploitation by the
    Promoter of the idea, video or other rights contained in any entry; and
    (v) does not contain any known virus, trojan horse, worm, trapdoor or similar
    software that may in any way infect or affect any of the Promoter's
    hardware or software systems.
  • The Promoter reserves the right to remove or temporarily suspend from the
    Promotion any entries submitted if, in its reasonable opinion, it suspects any breach
    of these Terms and Conditions or if it receives any complaint from a third party
    relating to such entry.
  • Entries received which are not submitted via the official entry method will not be
    accepted. Use of script, macro or any automated system to enter the Promotion is
    prohibited and entries made (or which appear to have been made) using any such
    system may be treated as void. Any illegible, incomplete or fraudulent entries will be
    rejected. No purchase of any product or service is required to enter into this
    Promotion. Participants should be aware that they may be subject to data charges at
    the usual rate depending on their own individual arrangements for Internet access if
    they enter the Promotion online or by email.
    Winners and Prizes
  • There will be 1 winner. One prize per winner. There will also be 3 runners up. One
    prize per runner up.
  • The overall winner will be the entrant whose entry best demonstrates how their
    nominee has made a difference to the lives of others. The runners up will be the next
    3 valid entries who are the next best at satisfying the judging criteria. The winner and
    runners up will be selected by a panel of judges (including at least one independent
    member). The decision of the judges shall be final. The names of the judges for a
    Promotion can be made available on request.
  • The prize is 2 flights with Virgin Atlantic. Prize includes 2 return economy class flights
    from London Heathrow airport to any international airport on Virgin Atlantic's flight
    network served by London Heathrow. Exact flight date/time will be selected at prize
    provider’s discretion. Subject to availability, prize must be booked in advance. Prize
    must be taken before 7 July 2025, subject to availability. Popular dates (weekends,
    school and public holidays) fill quickly and the prize provider cannot guarantee
    availability. The Prize will be forfeited if not taken before 7 July 2025 and no
    alternative or compensation will be given. Virgin Atlantic does not accept
    responsibility if winner is not able to take up the Prize. The Prize may not be used in
    conjunction with any other promotion or promotional fare offered by Virgin Atlantic
    or any third party. Bookings must be made at least 14 days in advance. Winner and
    his/her guest(s) must travel on same itinerary. All parts of prize must be used in
    conjunction with same booking. Any additional tickets will be charged at the full
    published fare at the time of booking. Once a booking has been made no changes are
    permitted. If a booking is cancelled no alternative tickets will be issued. Virgin Atlantic
    schedules are subject to change without notice. Virgin Atlantic reserves the right to
    substitute each ticket for an alternative equivalent flight if for any reason beyond the
    control of Virgin Atlantic, Virgin Atlantic is unable to fulfil the tickets. Airport transfers,
    accommodation, car parking charges, car hire, lounge access, meals and refreshments
    (other than those made available inflight on a complimentary basis), excess baggage
    charges, excursions and attractions not included. All applicable taxes, fees, charges
    and surcharges relating to the tickets shall be paid by the prize provider (Virgin
    Atlantic). Winner and his/her guest(s) are solely responsible for ensuring they have
    valid travel documentation (including passport/visa/visa waiver as may be required),
    obtaining adequate travel insurance and medical insurance and appropriate
    vaccinations / inoculations for foreign travel at their own expense. Winner must
    provide full name, date of birth, valid ESTA or US Visa and passport, mobile number
    and email address to the prize provider when booking their flights and all details are
    subject to verification. Virgin Atlantic reserves the right to ease operating to any route
    and shall offer the winner an alternate flight. No Virgin Atlantic Flying Club miles or
    tier points will be awarded. Flying Club miles cannot be redeemed to upgrade tickets.
    Winner agrees to release Virgin Atlantic from any liability whatsoever for any claims,
    costs, injuries, losses or damages of any kind arising out of or in connection with the
    Promotion or with the acceptance, possession, attendance at or use of any ticket
    (except death or personal injury caused by the Promoter’s negligence, for fraud or
    otherwise as prohibited by law). Winner and guest must abide by and are subject to
    Virgin Atlantic’s published Conditions of Carriage, which are available at
    http://www.virginatlantic.com/gb/en/help-centre/conditions-of-carriage.html.
  • The runners up prize is 4 general admission tickets to a Merlin attraction in the UK.
    Winner and guests are responsible for travel to and from the attraction at their own
    expense. Tickets are subject to availability, non-refundable, non-transferable, cannot
    be exchanged and are only valid for entry at the attraction specified. Tickets have no
    cash value and will be void and invalid if transferred to parties other than the runners
    up. Tickets are not for re-sale and a breach of this condition will enable the Attraction
    or the Promoter to cancel the tickets without prior notification, compensation or
    liability. Promoter reserves the right to substitute tickets for a different attraction and
    date without notice if ticket(s) to the advertised attraction become unavailable for any
    reason and/or at its sole discretion. The prize is subject to the terms and conditions of
    Merlin Entertainments, which can be found at virginatlantic.com and merlinentertainments.biz and their privacy policy will apply to the processing of your personal information.
  • Prizes are as stated and are non-exchangeable and non-transferable. There is no cash
    or other alternative to the prize in whole or in part.
  • The winner is responsible for paying all associated costs that are not specifically stated
    in any Promotional materials or these Terms and Conditions, including (where
    applicable) transport, accommodation, meal costs, spending money, insurance and all
    other incidentals. Winners are also personally responsible for any personal or
    incidental expenses and any VAT, national and/or local tax liabilities incurred in
    claiming or using the prize. If the winner's companion is a minor, the minor must be
    accompanied by his or her parent or legal guardian (at their own expense). By
    participating in the Promotion, participants agree that the prize is awarded on an "as
    is" basis, and that neither the Promoter nor any of its subsidiary or affiliated
    companies, make any guarantees, representations or warranties of any nature with
    respect to the prize.
  • In the event that, for reasons beyond the Promoter’s reasonable control, the
    Promoter is unable to award the prize as described in these Terms and Conditions, the
    Promoter reserves the right to award a prize of a similar nature and an equivalent
    value, or at its sole discretion, the cash value of the prize. The Promoter also reserves
    the right to award a prize of a similar nature and an equivalent value, or at its sole
    discretion, the cash value of the prize if in its reasonable discretion it is appropriate to
    do so.
  • The Promoter may amend or withdraw any element of a competition, prize draw, vote
    or poll for reasons beyond their reasonable control, including but not limited to the
    unavailability of the vote, poll, competition or prize draw entry platform before the
    closing date, or for strike, lock-out, labour dispute, illness, act of God, natural disaster,
    adverse weather conditions, war, riot, civil commotion, accident, public health
    concern in relation to potential infection, epidemic or pandemic, malicious damage,
    fire, flood and/or storm, compliance with law or governmental order, rule, regulation
    or direction, breakdown of plant, machinery or transportation.  The Promotor is
    not responsible for any loss or damage caused to you as a result of any of these
    occurrences. Therefore the Promoter shall not be responsible if a winner or runner-
    up is unable to redeem their prize for any time period as a result of government
    guidelines or restrictions resulting from COVID-19. No alternative booking dates or
    compensation will be made available in these circumstances.
    Winner Announcement and claiming of prize
  • Winners and runners up will be notified by email or using the other contact details
    provided to the Promoter within 10 days after the end of the Promotion Period. All
    reasonable endeavours will be made to contact the winner and runners up during the
    specified time. If a winner or runner up cannot be contacted or is not available, the
    Promoter reserves the right to re-draw another winner or runner up as applicable
    from the valid/correct entries that were received during the Promotion Period.
    Winners and runners up may be required to submit valid identification before
    receiving their prize.
  • Winners and runners up will be required to confirm acceptance of the applicable prize
    within 14 days of having been notified. If the winner or runner up has not claimed
    their prize by the date specified, the Promoter reserves the right to award the prize to
    another participant.
  • The prize will be delivered within a reasonable time and by no later than 28 days after
    the prize has been accepted.
  • The Promoter proposes to make available a list of winners, subject to any objections
    from the relevant individuals.  For a copy of the list, please send a stamped self-
    addressed envelope by no later than 28 days after the end of the Promotion Period to
    News UK, Promotions Department, 1 London Bridge Street, London, SE1 9GF stating
    for which Promotion you would like winners’ details.  If a winner objects to this
    information being made available, they should inform the Promoter at the earliest
    opportunity using email help@thsun.co.uk/.  Winners acknowledge that the Promoter
    may still be required to share their details with the Advertising Standards Authority or
    other regulators.
    Data Protection and Publicity
  • The Promoter will collect and process participants' personal information in
    accordance with the privacy policy at http://www.newsprivacy.co.uk/. The
    information provided may be shared with the Promoter's agents, affiliates and, if
    applicable, any third party prize provider (including those outside the UK/European
    Economic Area) who will process such information in accordance with their own
    privacy policy. Information provided by participants will be used for the purpose of
    conducting this Promotion (including for prizes to be delivered) and other purposes as
    may be specified and/or consented to at the time of entry or on promotional
    materials. If participants do not provide any of the mandatory information requested
    when participating in the Promotion, their entry will be void. 
  • The Promoter is required to either publish or make available information that
    indicates a valid award took place. As such, the Promoter will send the surname and
    county of major prize winners and, if applicable copies of their winning entries, to
    anyone that contacts the Promoter at the address given above by no later than 28
    days after the end of the Promotion Period.
  • If a winner or runner up objects to any or all of their surname, county and winning
    entry being published or made available, they should contact the Promoter at the
    address given above. In such circumstances, the Promoter must still provide the
    information and winning entry to competent authorities, including the Advertising
    Standard Authority, on request.
  • Participants will retain copyright in their submitted entries to the Promotion,
    however, by entering, all entrants grant the Promoter a worldwide, royalty-free,
    perpetual licence to edit, publish and use each Promotion entry in any and all media
    (including print and online) for publicity and news purposes in respect of all
    intellectual property rights arising in and related to the entries in question.
    Participants acknowledge and agree that they have all rights necessary to grant the
    rights provided for in this paragraph 23, and that all materials forming part of their entry to the Promotion, and any use of such materials by or on behalf of the Promoter, comply with all applicable laws, rules, and regulations and do not infringe or otherwise violate the intellectual property or other rights of any third party, including privacy rights.
